This policy is a general statement of our practices for the Labour Market platform. It does not constitute legal advice. We recommend that you seek independent legal advice where required.
1. Who we are
Labour Market (“we”, “us”, “our”) operates an online recruitment and workforce platform connecting candidates, employers, and sponsors in South Africa. We are the responsible party for personal information processed through labourmarket.co.za and related services, in terms of the Protection of Personal Information Act 4 of 2013 (POPIA).
2. Lawful bases for processing
We process personal information where one or more of the following applies:
- Consent — for example, marketing communications or optional profile sharing.
- Contract — to create accounts, process applications, run interviews, and deliver subscription services you request.
- Legal obligation — tax, employment, regulatory, or court requirements.
- Legitimate interest — platform security, fraud prevention, service improvement, and administering our business, balanced against your rights.
3. Categories of information we collect
- Identity and contact: name, email, phone, address, date of birth, national ID or passport details and copies.
- Employment and education: CV, work history, qualifications, skills, professional references, interview outcomes, and employment contract information.
- Organisation data: company registration, tax numbers, director details, and supporting business documents (employers and sponsors).
- Financial: billing details, invoices, and payment references processed via payment providers (we do not store full card numbers).
- Usage and technical: login activity, IP address, device/browser data, and cookies as described in our Cookie Policy.
- Special personal information (only where necessary and permitted): for example disability-related information you choose to provide for reasonable accommodation.
4. How we use information
- Account registration, verification, and profile management
- Job matching, applications, screening, interviews, and hiring workflows
- Subscription billing, invoices, and payment processing
- Reference checks and related employer add-on services (where subscribed)
- Service notifications, support, and (with consent) marketing
- Security, audit, analytics, and product improvement
- Compliance with law and responding to lawful requests
5. Sharing and operators
We do not sell personal information. We may share information with:
- Employers and sponsors for recruitment and programme purposes, consistent with your use of the platform and applicable consents.
- Operators / processors who help us run the service, including hosting providers, email delivery, analytics (if enabled), and PayFast for payments.
- Professional advisers and authorities where required by law.
Operators are required to process information only on our instructions and to implement appropriate security measures.
6. Cross-border transfers
Some operators may process data outside South Africa. Where we transfer personal information across borders, we take steps consistent with POPIA, including ensuring an adequate level of protection or obtaining necessary consents.
7. Retention
We retain personal information only for as long as needed for the purposes above, including recruitment history, billing records, and legal retention periods. When no longer required, we delete or de-identify information in a secure manner.
8. Children
Our services are not directed at children under 18. We do not knowingly collect personal information from minors without appropriate authorisation.
9. Marketing
You may opt out of marketing emails at any time using the unsubscribe link or by contacting us. Transactional and service messages (for example billing or application updates) may still be sent.
10. Your rights (data subject access)
Under POPIA you may request access, correction, deletion (subject to legal limits), objection to processing, and withdrawal of consent where processing is consent-based. To exercise these rights, email our Information Officer at privacy@labourmarket.co.za or use our contact form.
11. Complaints
You may lodge a complaint with the Information Regulator (South Africa) (enquiries@inforegulator.org.za).
12. Changes
We may update this policy from time to time. The effective date above will be revised when material changes are published.
