Terms of Service - Labour Market

Effective date: 16 July 2026

These Terms govern use of the Labour Market platform. They are a general template and do not replace advice from your own attorney.

1. Acceptance

By accessing or using Labour Market you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.

2. Accounts and eligibility

You must provide accurate registration information and keep credentials confidential.
You are responsible for activity under your account.
Organisational accounts may only be used by authorised representatives.
We may suspend or terminate accounts that breach these Terms or applicable law.

3. Candidates

Profiles, CVs, and applications must be truthful and current.
You must not misrepresent qualifications or submit fraudulent documents.
Optional paid features (for example CV package downloads) are charged as described at checkout.

4. Employers and sponsors

Job posts must be for genuine opportunities and comply with South African labour and equality laws.
Candidate data may only be used for legitimate recruitment or programme purposes.
Sponsors must manage affiliated employers and programmes in good faith and in line with applicable B-BBEE and related rules.
Add-on modules (for example talent pipeline or reference checks) require an active entitlement and may be billed on separate invoices.

5. Subscriptions, billing, and refunds

Paid plans and add-ons are billed according to the selected interval and pricing shown at purchase.
Proforma and tax invoices may be issued; payment may be processed via PayFast or other approved methods (including EFT where offered).
Unless required by law or expressly stated otherwise, fees are non-refundable once a billing period has started. Contact support for billing disputes.
Failure to pay may result in suspension of paid features.

6. Acceptable use

You must not:

Harass, discriminate against, or abuse other users
Post false, misleading, or unlawful content
Scrape, reverse engineer, or overload the platform without permission
Circumvent security, access controls, or billing
Use the service for spam or illegal activity

7. Intellectual property

Labour Market branding, software, and content (excluding your own uploads) remain our property or that of our licensors. You retain ownership of materials you upload and grant us a licence to host and process them to provide the service.

8. Disclaimers

The platform is provided on an “as is” and “as available” basis. We do not guarantee that any candidate will be hired, that any job will be filled, or that third-party information is accurate. We are not a party to employment contracts between users unless expressly agreed in writing.

9. Limitation of liability

To the fullest extent permitted by South African law, we are not liable for indirect, incidental, or consequential loss, or for employment decisions made by users. Our aggregate liability arising from these Terms is limited to the fees you paid us for the service in the three months preceding the claim, except where liability cannot be limited by law.

10. Termination

You may stop using the service at any time. We may suspend or terminate access for breach, risk, or non-payment. Provisions that by nature should survive (including IP, liability, and governing law) survive termination.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Courts of South Africa have jurisdiction, without prejudice to mandatory consumer protections. Parties should first attempt to resolve disputes in good faith via info@labourmarket.co.za.

12. Changes

We may update these Terms. Material changes will be reflected by updating the effective date. Continued use after changes constitutes acceptance where permitted by law.
